It has now been confirmed that the requirement for premises in England who produce more than 500kg of hazardous waste per annum to be registered with the Environment Agency will no longer be required from the 1st April 2016. Up until this date it is still a legal requirement as full traceability must be demonstrated. The exact layout of the new Consignment Note and Consignment Code is still under discussion with guidance from the Environment Agency due in the New Year. Natural Resource Wales are still keeping the Hazardous Waste Producer Registration so companies based in Wales who produce more than 500Kg of Hazardous Waste will still need to resister.

In a trial lasting over three weeks a company has been fined £14.2 million (€20million) for not holding a valid permit and disposing of waste in an unsafe and illegal manner*. Disposing of waste improperly can cause damage to the environment as well as plant and animal life. Over the course of the trial it came to light that the company had dumped illegal waste over a 5 year period, causing significant risks to the surrounding countryside, waters and atmosphere.

A lorry driver has been imprisoned for causing a chemical spill on a major road in Suffolk. A water solution of chemical acrylamide spilled from the curtain cover onto the road, causing an 8 hour delay for drivers and costing taxpayers £130,000. The driver has since been jailed for ten months, and disqualified from driving for eighteen months due to “driving without due care and attention, driving without a valid training certificate, driving a dangerous goods vehicle without displaying an orange placard and driving a dangerous goods vehicle without personal protection equipment”. Large businesses that miss the first Energy Savings Opportunity Scheme (ESOS) compliance deadline of the 5th December 2015 are not likely to be penalised providing that they submit their first assessment to the Environment Agency (EA) by the end of January 2016. The deadline for an ESOS assessment of 5th December 2015 is fast approaching and applies to large undertakings and their corporate groups that, on the 31 December 2014 employs over 250 people or has an annual turnover of €50 million or more. It mainly effects businesses but in addition it can also apply to not-for-profit bodies and any other non public sector undertakings that are large enough to meet the qualification criteria.

Penalties for Non Compliance include for Companies registered/ principal place of activity in England “ a fixed penalty of up to £5,000 and an additional £500 for each working day starting on the day after service of the penalty notice until the notification is completed, subject to a maximum of 80 days” taken from Complying with the Energy Savings Opportunity Scheme Environment Agency Version 2.0 (see following download link):

With the forthcoming changes to waste classification there will be a slight delay in the EU Regulation being fully implemented in England. New domestic Regulations are required, but have been slowed by the general election. The Environment Agency recognise the potential inconvenience and burden on waste producers and the industry, and have provided a regulatory position (see below) that allows the adoption of the new classification criteria early, if users chose to.

New rules on waste classification

The long awaited final version of WM3 has now been published and can be found at the .gov website. The implementation date however for England is yet to be announced with an estimation implementation date of mid-to-late June. This is later than Northern Ireland who will implement on the 1st June and Scotland on the 8th June respectively. Wales have also yet to advise their implementation date.

Although this gives customers a little more time to re-classify their waste-streams they should not leave it too late. Xenon Technical Services are available to help with this transition so please contact us with any queries.

WM3 is set to be published on the 14th May 2015 which only leaves just over two weeks to reclassify waste for the 1st June 2015 deadline.

Xenon Technical Services has already begun to work with existing clients to make the changeover as smooth as possible and has been involved in the Consultation Process and using knowledge of the up-to-date amendments from a meeting at CIWM Headquarters last month.
